At CFS Collection we are able to offer our services to business and individuals that have encountered problems in collecting overdue payments. Our collection model allows you to chose the service that best meets your needs, from letters and telephone calls through to judgments and enforcement. This is achieved by using our dedicated collectors who work closely with our trusted partners to ensure we deliver exceptional results time and time again.
Our Debt Collection Services Include:
Letters & Telephone Calls Before Action
On instructing our specialist debt recovery team we will work with you to determine a process of letters before action followed by telephone calls, our system will email confirmation of any response we receive from the debtor. In order to instruct our services and you have less than 10 cases, please complete the relevant form.
Issue Legal Proceedings
- If payment in full is not received after our letter before action we will refer back to you to confirm if you wish to commence court action (please see our costs & fee’s schedule).
- Our claim form will detail the debt due and will include a claim for interest as well as solicitors and court costs.
- Once the claim is issued at Court, the debtor has 14 days to respond by either acknowledging the debt (in which case a further 14 days is allowed, 28 days from issue in total) or by; admitting the debt and/or offering a rate of repayment; part admitting the debt and/or offering a rate of repayment or; to defend and/or lodge a counterclaim.
- If no response is received after 14 days you are entitled to request Judgment often referred to as a CCJ.
- All court action is processed through our preferred firm of solicitors.
Judgment
On your instruction, a request for default Judgment is lodged at Court where a debtor has failed to respond to the claim issued against them at Court. Judgment is entered by the Court for the total amount payable including all interest since the claim was issued, solicitors fixed costs and court fee paid. The Judgment states that the amount is payable forthwith and provides the debtor with one month to pay in full, failing which it will appear on their credit record and consequently effect their credit rating.
Enforcement
The enforcement methods we provide through our trusted partners are:
- Warrant of Execution – enforcement by County Court Bailiff (Judgments less than £600)
- Writ of Fi Fa – enforcement by High Court Enforcement officer ( Judgments more than £600)
Tracing
The first stage in collecting a debt is often to find the debtor. Our preferred partners have many years experience in tracking down even the most elusive debtor. Professional debtors tend to move frequently but our agents are experienced in tracing this type of debtor. The more information you can provide with regard to the debtor the better. Addresses, telephone numbers (even if no longer in use) and former employer’s details will all help our agents to build up a picture of the debtor and to trace them quickly and effectively.
